Terms of Service

1. Acceptance of terms

By accessing or using APEX you confirm that you can form a binding contract and that you accept these Terms and our Privacy Policy. If you use APEX on behalf of a school or organisation, you confirm you are authorised to accept these Terms on its behalf.

2. Eligibility and accounts

You must provide accurate registration information and keep your password secure. You are responsible for all activity under your account. You must be old enough to consent to use online services in your country, or have permission from a parent or guardian. One person may not maintain multiple free accounts to bypass usage limits.

3. Licence to use APEX

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use APEX for your own studies. You may not resell, redistribute, or commercially exploit the service or its content without our written permission.

4. Subscriptions and payment

APEX offers a free plan and paid plans. Paid subscriptions are billed in advance through our payment processor on a recurring basis until cancelled. You authorise us to charge your chosen payment method for each billing period. Prices may change with notice; changes do not affect the period already paid for.

5. Free plan and usage limits

The free plan includes a limited number of tasks per day and other limits described on the pricing page. We may adjust free-plan limits to keep the service sustainable. Limits reset on a daily basis as described in the app.

6. Cancellation and refunds

You may cancel a subscription at any time; it remains active until the end of the current billing period and is not renewed thereafter. Except where required by law, payments are non-refundable. One-time bundles (such as an exam-season plan) grant access for their stated duration and are non-refundable once activated.

7. Acceptable use

You agree not to:

• Use APEX for anything unlawful or to infringe others’ rights.
• Attempt to disrupt, reverse-engineer, scrape, or overload the service or its AI systems.
• Share your account, resell access, or circumvent usage limits or paywalls.
• Submit content that is illegal, abusive, or violates intellectual-property rights.
• Use the service to cheat in a way that breaches your school’s or the IB’s academic-honesty rules.

8. AI-generated content

APEX uses AI to generate questions, mark answers and power the tutor. AI output can contain errors, may not perfectly match official IB mark schemes, and should be treated as study guidance — not authoritative or guaranteed assessment. Always verify important results against official materials and your teacher’s guidance. APEX does not guarantee any particular exam grade or outcome.

9. No IB affiliation

APEX is an independent study tool. It is not affiliated with, endorsed by, sponsored by, or approved by the International Baccalaureate Organization (IBO). "International Baccalaureate", "IB", and related marks are trademarks of the IBO and are used only descriptively to identify the exams APEX helps you prepare for.

10. Intellectual property

The APEX platform, software, design, branding and all generated content (other than your own submissions) are owned by APEX or its licensors and protected by law. These Terms do not transfer any ownership to you. See our Rights page for details on ownership and your own content.

11. Suspension and termination

We may suspend or terminate your access if you breach these Terms or use the service in a way that harms APEX or other users. You may stop using APEX and delete your account at any time. Sections that by their nature should survive termination (such as disclaimers, liability limits and intellectual-property terms) will continue to apply.

12. Disclaimers

APEX is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that the service will be error-free or that AI feedback will be correct.

13. Limitation of liability

To the maximum extent permitted by law, APEX and its team will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits, grades or opportunities arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

14. Indemnity

You agree to indemnify and hold APEX harmless from any claims, losses or expenses arising from your misuse of the service or breach of these Terms.

15. Governing law and disputes

These Terms are governed by the laws applicable at APEX’s place of establishment, without regard to conflict-of-law rules. You agree to resolve disputes there, except where mandatory local consumer law gives you other rights.

16. Changes to these terms

We may update these Terms from time to time. We will update the "last updated" date and, for material changes, notify you in the app. Continued use after changes take effect means you accept the revised Terms.
